If you accept an offer, is that a binding contract?

I was oversea receiving surgery when the realtor emailed me an offer on my property. I signed and initialed pages and sent it back, but later I learned that the buyer dropped out because she did not like waiting a month to move in. Of course, no one told me because I would have had no problem with that. The property is a Coop govern by an elected group of owners and they have their admission procedures but the Secretary told me that she did not see a problem. My property is still on the market and I believe that I am entitled to compensation for this contract violation, if that is what it is.

Normally a signed contract is binding. In most real estate contracts there are normally a few contingencies that might or must be accomplished prior to the contract really being enforceable.

If the buyer was not aware that the property would not be available immediately then that might be reason not to honor the contract as they might be required to leave their current residence prior to 30 days.

You might have an argument for your side, however, the buyer might also have an argument since apparently she wanted to move prior to 30 days which apparently was not part of the contract you signed.

Going over the contract might solve the problem.

The next question is do you want to spend your energy attempting to get this person into court, where you might lose and possibly be counter sued or are you really interested in selling your house?

Once you have answered this question you might would have come to a solution.
